The complaint alleges that the company designed, packaged, and promoted its products to appeal to children and teenagers while falsely presenting them as safe, FDA approved culinary tools.
According to the lawsuit, Galaxy Gas canisters feature bright colors and flavors such as vanilla cupcake, mango smoothie, and strawberry cream; packaging tactics commonly used to attract younger consumers. The company allegedly leveraged social media influencers on platforms like TikTok and YouTube to create viral trends, further fueling the product’s popularity among youth. Despite positioning its nitrous oxide as a kitchen product, the company allegedly knew and intended for its customers to inhale the gas recreationally, failing to warn them of the severe risks of addiction and neurological damage.
The lawsuit also claims Galaxy Gas violated multiple consumer protection laws by engaging in deceptive advertising and falsely implying its products were FDA-approved. This alleged misrepresentation created a false sense of security among consumers, downplaying the well-documented dangers of nitrous oxide abuse. The complaint seeks to hold the company accountable for its nitrous oxide sales and marketing practices, and to secure financial compensation for those harmed.
